We are delighted that you have chosen voyageplan as your partner for your next trip. We are happy to share our many years of experience with you and thank you for the trust you have placed in us.
If you have booked an arrangement produced in-house by voyageplan, these general terms and conditions of travel apply (PDF):
These general terms and conditions of travel apply to all bookings made with voyageplan, unless otherwise stated in the written confirmation.
1.1 Scope
These general terms and conditions of travel apply to all bookings made with voyageplan, unless otherwise stated in the written confirmation.
1.2 Services provided by third parties
For all ‘flight-only arrangements’ and individual services arranged by voyageplan, the general conditions of carriage of the airlines responsible or the general terms and conditions of the companies concerned apply. For services arranged on behalf of third parties, the contract is concluded directly between you and the company concerned. voyageplan accepts no liability for their performance of the contract.
2.1 Conclusion of the contract
The contract between you and voyageplan is concluded when your booking, made in person or by telephone with your booking agent, is accepted without reservation. From that moment, the rights and obligations arising from the contract (including these general terms and conditions of travel) take effect for you and for voyageplan. If you book in writing, by email, SMS, etc. or via our website, you will receive an express acceptance of your booking.
voyageplan is entitled to decline a booking within a reasonable period and without giving reasons.
2.2 Booking for several travellers
If you, as the person making the booking, book additional travellers, you are liable for their contractual obligations (in particular payment of the travel price) as you are for your own.
The contractual agreements and these general terms and conditions of travel apply to all travellers (including ‘substitute travellers’ as set out in section 5.5).
2.3 Names
When booking, you are obliged to give your name and the names of your fellow travellers exactly as they appear in the identity document used for the trip (passport, etc.). If the names in the travel documents, in particular on the flight ticket, do not match the names in the identity document (for example Charly instead of Charles or Nath instead of Nathalie), you may be refused the travel service, for instance by the airline, or costs may be incurred for reissuing the ticket. In this case, services not used will not be refunded.
3.1 Our services
3.1.1 Our services are set out in the description of services in our brochure, on our website, in the trip description and in the travel confirmation. Special requests on your part or additional agreements only form part of the contract if they have been confirmed in writing and without reservation by the booking agent.
3.1.2 The booking agent is not authorised to give you any assurances that do not arise from our own brochure, our website or other documents issued by us.
3.1.3 If the booking agent provides you with material we have not published ourselves, such as hotel brochures, this information is not binding on us. The same applies to information you receive directly from service providers or obtain on the internet, in forums, etc.
3.2 Start of services
Unless otherwise stated in the trip description, voyageplan’s services begin at the airport in Switzerland, for coach tours at the coach’s point of departure and for voyages by ship at the port of embarkation.
You are responsible for arriving at the starting point of your trip in good time. This also applies if the booking agent organises your journey to the starting point outside our programme.
3.3 Names of the operating airlines
We are required by law to inform you of the names of the operating airlines as soon as they are known. We reserve the right to replace one airline with another. In this case, you will be informed of the name of the new airline as quickly as possible.
4.1 Prices
The prices of package arrangements are listed in the brochure or price list, on the internet or in other advertising media. Unless otherwise stated in the offer, the price list or on the website, the prices of package arrangements are per person based on accommodation in a double room. Prices are quoted in Swiss francs.
The prices valid at the time of booking for the chosen departure date apply.
For price changes after conclusion of the contract, see section 6.
4.2 Payment by credit card and Reka-Checks
Our prices are cash prices. For payment by credit card, we add a surcharge of 1%, subject to a minimum of CHF 20.00. For payment by Reka-Checks, we add a surcharge of 3.5%, subject to a minimum of CHF 20.00. We do not accept Reka-Rail.
4.3 Age-dependent prices
Where prices depend on the age of the person concerned, such as child discounts, the age at the start of the trip (date) is decisive. If incorrect information is given, we reserve the right to recalculate the travel price and invoice any difference. This also applies after the trip has ended.
4.4 Terms of payment
4.4.1 On conclusion of the contract, the following deposit is payable: 30% of the total invoice amount within 10 days. Insurance premiums must be paid together with the deposit. Flight tickets and services that must be guaranteed by payment are included in the deposit, even if it exceeds 30%.
4.4.2 The balance of the travel price must be paid no later than 45 days before departure.
4.4.3 If the deposit or the balance is not paid on time, we are entitled to refuse the travel services after a short period of grace. In this case, the trip is deemed to have been cancelled and the cancellation fees in accordance with section 5 become payable.
4.4.4 If payment by credit card is not honoured, section 4.4.3 applies. If you are already travelling, the full travel price remains due, plus any default interest and collection costs.
4.5 Short-notice bookings
For last-minute bookings, the total invoice amount is payable on conclusion of the contract. In all other respects, sections 4.2 to 4.4.4 apply accordingly.
4.6 Booking fees
We charge the following booking fees in addition to the travel price: flat booking fee per order CHF 70.00
For flight bookings, we charge a processing fee of CHF 40.00 per ticket. In addition, the following booking fees apply per ticket:
European flight ticket (Ticket Service Charge) CHF 50.00
Intercontinental flight ticket (Ticket Service Charge) CHF 100.00
Business Class flight ticket CHF 210.00
First Class flight ticket CHF 310.00
4.7 Booking fees and advice from your travel agency
Please note that, in addition to the prices listed in the brochure or trip description, your booking agent may charge further fees for advice and booking. Your booking agent will inform you of these.
4.8 Travel documents
4.8.1 Unless otherwise agreed, your travel documents will be handed over or sent to you once we have received payment of the total invoice amount, usually 10 days before the start of the trip. If you do not receive your travel documents (tickets, hotel vouchers, etc.) within this period, please notify your booking agent immediately.
5.1 General
If you wish to change your booking or cancel the trip, you must notify your booking agent in person or by registered letter. Any travel documents you have already received must be returned to the booking agent at the same time.
5.2 Processing fees
5.2.1 For changes to a booking, such as a change of name, nominating a substitute traveller, changing the travel dates within the validity period of the travel programme, the additionally booked services, the destination or the place of departure, etc., as well as in the event of cancellation, a processing fee of CHF 60.00 per person, up to a maximum of CHF 120.00 per booking, will be charged (see section 5.3).
5.2.2 Changes and rebookings within the cancellation periods set out below (see section 5.3) are deemed to be a cancellation with a simultaneous new booking. If the change or rebooking incurs only minor costs, only these will be charged.
5.2.3 For changes or rebookings outside the validity period of the trip description, the cancellation conditions in accordance with section 5.3 apply.
5.2.4 If you have taken out cancellation insurance (section 5.4), please refer to your insurance policy to see whether these processing fees are covered by the insurance company.
5.3 Cancellation fees
5.3.1 For changes, rebookings or cancellations made less than 45 days before the start of the trip, the following cancellation fees will be charged in addition to the processing fees (section 5.2):
45 – 31 days before departure: 25 % of the travel price
30 – 15 days before departure: 50 % of the travel price
14 – 8 days before departure: 75 % of the travel price
7 – 0 days before departure, no-show: 100 % of the travel price
5.3.2 International flights: processing fee before the ticket is issued: CHF 60.00 per ticket, max. CHF 120.00 per booking. Cancellation fees after the ticket has been issued: CHF 200.00 per ticket, plus the airline’s official fees (up to a maximum of 100%, depending on the airline).
5.3.3 Any different cancellation fees are stated in the trip description or on the invoice confirmation.
5.3.4 The date of cancellation or change is determined by the time at which your notice of cancellation reaches the booking agent during normal office hours; on Saturdays, Sundays and public holidays, the next working day applies. This rule also applies to notifications sent by email, via our website, to our answering machine, to our fax machine or by other electronic means.
5.4 Cancellation insurance
5.4.1 We recommend that you take out cancellation insurance. The cancellation fees will then be covered in the event of a claim. The insurance policy valid at the time of booking applies.
5.4.2 In the event of cancellation, your booking agent will, at your express request, handle the insured event with the insurance company. The booking agent may charge you a processing fee for this work.
5.4.3 If you cancel the trip, the cancellation insurance premium remains due and will not be refunded. Even if you have taken out cancellation insurance, you remain liable for the cancellation fees.
5.5 Substitute travellers
If you have to cancel your trip, you may nominate a substitute. The substitute must be willing to enter into the contract on the existing terms. They must also meet the particular travel requirements (health, etc.), and no legal provisions or official orders may prevent them from taking part. For certain trips, owing to special conditions of carriage and other conditions, no change can be made, or only up to a certain point in time (which may differ from the periods stated below).
A substitute can usually take over the booking:
a. for trips within Switzerland, up to the start of the trip;
b. for trips within Europe and to countries without visa requirements, up to two days before the start of the trip (not counting the day the trip begins);
c. for trips abroad and to countries with visa requirements, after consultation with your booking agent and within the limits of our organisational capabilities (time required to obtain visas, reissue documents, etc.)
The processing fees (see section 5.2) and any additional costs incurred are borne by you and the substitute. If a substitute takes over the contract, you are jointly liable with them for payment of the trip.
voyageplan will inform you within a reasonable period whether the nominated substitute can take part in the trip (in high season this may take several days); trips with participation requirements involve a check.
If you nominate the substitute too late, or if they are unable to take part due to travel requirements, official regulations, legal provisions, etc., your withdrawal from the trip is deemed to be a cancellation (see sections 5.2 et seq.).
6.1 Changes before conclusion of the contract
voyageplan expressly reserves the right to change the information in the brochure, the descriptions of services, the offers on its website, etc., as well as the prices before you book. In this case, your booking agent will inform you before the contract is concluded.
6.2 Price changes after conclusion of the contract
6.2.1 Price increases after conclusion of the contract may result from:
a. a subsequent increase in transport costs (including fuel surcharges);
b. newly introduced or increased levies or fees (such as airport taxes, landing fees, embarkation and disembarkation fees, security charges, the introduction or increase of state taxes and fees, government-imposed price increases, etc.)
c. exchange rate fluctuations.
If the cost of these travel services rises, it may be passed on to you. The travel price will increase accordingly.
6.2.2 We will inform you of any price increase no later than 3 weeks before the start of the trip. If the price increase exceeds 10 % (based on the total travel price per person), you are entitled to the rights set out in section 6.4.
6.3 Programme changes and changes to transport after your booking and before the start of the trip
voyageplan also reserves the right, in your interest, to change the travel programme or individual agreed services (such as accommodation, means of transport, airlines, flight times, etc.) in the event of force majeure, unforeseeable or unavoidable circumstances, official measures, strikes, etc. voyageplan will endeavour to offer you equivalent alternative services.
voyageplan will inform you as quickly as possible of any such changes and their effect on the price.
6.4 Your rights if, after conclusion of the contract, the travel price is increased, the programme is changed or changes to transport occur
6.4.1 If the change to the programme or to individual agreed services results in a significant change to an essential element of the contract, or if the price increase exceeds 10% of the total travel price per person, you have the following rights:
a. You may accept the change to the contract;
b. You may withdraw from the contract in writing within 5 days of receiving our notification, and the travel price already paid will be refunded to you without delay;
c. Or you may inform us in writing within 5 days of receiving our notification that you wish to take part in an equivalent alternative trip offered by us. We will endeavour to offer you such an alternative. If the alternative trip is cheaper, the price difference will be refunded to you. If the alternative trip is more expensive, the originally agreed price is payable.
6.4.2 If you inform neither us nor the booking agent in accordance with section 6.4.1 b. or c., you are deemed to have accepted the price increase, the programme change or the change to the individual agreed services. The five-day deadline is met if the letter is posted on the 5th day.
7.1 Cancellation for reasons attributable to you
voyageplan is entitled to cancel your trip if your conduct justifies such a measure. In this case, voyageplan will refund the travel price already paid; any further claims are excluded. Cancellation fees in accordance with sections 5.2 et seq. and claims for damages remain reserved.
7.2 Minimum number of participants
Certain trips by the tour operator or by voyageplan require a minimum number of participants, which is stated in the respective trip description. If the minimum number of participants is not reached, the tour operator may cancel the trip no later than three weeks before the start of the trip. In this case, we will refund the travel price paid (insurance premiums are not refunded and remain due). Any further claims on your part are excluded.
7.3 Unforeseeable events, force majeure, strikes
7.3.1 In the event of unforeseeable or unavoidable events, force majeure (e.g. natural disasters, epidemics, unrest), official measures of any kind or strikes that make the trip more difficult, endanger it or make it impossible, the tour operator or voyageplan may cancel the trip. In this case, the travel price paid will be refunded (insurance premiums are not refunded and remain due). Any further claims on your part are excluded.
7.3.2 When deciding whether a trip can go ahead, we take into account the recommendations of the Federal Department of Foreign Affairs (FDFA) and the Federal Office of Public Health (FOPH) and assess whether there is a specific danger to the trip and/or its participants. In the event of an actual and specific danger, or a possible future specific danger, we reserve the right to cancel the trip.
8.1 The tour operator or voyageplan will endeavour to carry out the trip as agreed. However, changes to services and the programme may prove necessary. In this case, the tour operator or voyageplan will, where possible, offer you an equivalent solution. If the alternative would involve disproportionate effort or disproportionate costs for voyageplan, voyageplan may decline to provide such an alternative. Any additional costs are borne by the travellers.
8.2 If programme or service changes or the non-provision of services are due to force majeure, voyageplan is entitled to decline to offer an alternative. Any additional costs are borne by the travellers.
8.3 If the change to services or the programme affects a significant part of the agreed trip, voyageplan will reimburse you for any objective difference in value between the agreed travel price and the value of the services provided (see section 11).
9.1 If you have to cut your trip short or are unable to use individual services, the price of the package and of the services not used cannot be refunded. Any services not used will be refunded to you, less a reasonable processing fee, provided they are not charged to voyageplan by third-party partners, they are not minor services and the refund does not conflict with legal or official provisions.
9.2 In emergencies (e.g. illness or accident, serious illness or death of a relative), the tour operator’s tour guide, the tour operator’s local representative, the service provider or voyageplan will, where possible, help you to organise your return journey.
9.3 All costs, for example for transport etc., are borne by you. In this context, please also consider taking out return journey insurance, which is not included in the travel price. Your booking agent will be happy to provide further information on request.
10.1 Deadline for complaints and request for a remedy
If the trip does not correspond to the contractual agreement or you suffer damage, you are obliged to contact the tour operator’s tour guide or the tour operator’s local representative immediately, report the defect or damage identified and request a remedy. If there is neither a tour guide nor a representative of the tour operator on site, the service provider concerned must be informed and asked to remedy the situation.
10.2 The tour operator’s tour guide, the tour operator’s local representative or the service provider will endeavour to provide a remedy within a reasonable period. If no remedy is provided within a reasonable period, or if the remedy offered is inadequate, you must have the defects claimed or the damage suffered, as well as the lack of a remedy, confirmed in writing by the tour operator’s tour guide, the tour operator’s local representative or the service provider. These persons are not authorised to acknowledge claims for damages of any kind.
10.3 If, contrary to expectations, you are unable to contact the tour operator’s tour guide, the tour operator’s local representative or the service provider, or if they do not help you, please contact us directly. You will receive the necessary details with your travel documents.
10.4 Depending on the destination, a different procedure for defects and damage may be agreed.
10.5 Self-remedy
If no remedy is provided within a reasonable period and the defect is a significant one, you are entitled to remedy the situation yourself. The costs you incur as a result will be reimbursed by the tour operator against receipts, within the scope of the originally agreed trip (hotel category, means of transport, etc.), provided you have lodged a complaint and requested written confirmation (see sections 10.1 to 10.3; for details see section 11).
10.6 How to assert your claims against voyageplan
If you wish to assert claims for defects, refunds or damages against voyageplan, you must submit your complaint to voyageplan in writing within one month of the contractual end of the trip. The complaint must be accompanied by the confirmation from the tour operator’s tour guide, the tour operator’s local representative or the service provider, together with any supporting evidence.
10.7 Forfeiture of your claims
If you do not report defects or damage in accordance with sections 10.1 to 10.3, you forfeit all claims, such as the right to a remedy, self-remedy, a reduction of the travel price, termination of the contract, damages, etc. The same applies if you have not asserted your claim with us in writing within one month of the end of the trip. The provisions on luggage on flights remain reserved (see section 10.8).
10.8 Luggage on flights
Damage to luggage or its delayed delivery must be reported immediately on the spot to the airline responsible by means of a damage report (P.I.R.). As a rule, airlines reject claims for damages if no damage report has been filed or if the claim is made late.
You forfeit all claims if damaged luggage is not reported within 7 days of receipt and if damage resulting from the delayed delivery of luggage is not reported within 21 days of the luggage being made available.
11.1 General
Subject to the following provisions, voyageplan will reimburse you for the value of services that were agreed but not provided or provided inadequately, for your additional costs and for any damage suffered, insofar as the tour operator’s tour guide, the tour operator’s local representative, the service provider or we are unable to provide an equivalent alternative service on site.
In the case of self-remedy (section 10.5), your additional costs will be reimbursed up to a maximum of twice the travel price per person or per traveller. The provisions of sections 8.1 et seq. remain reserved.
11.2.2 Exclusions of liability
voyageplan accepts no liability if the non-performance or improper performance of the contract is due to the following causes:
a. omissions on your part before or during the trip;
b. unforeseeable or unavoidable omissions by a third party not involved in providing the contractually agreed services;
c. force majeure or an event that voyageplan or the service provider could not foresee or prevent despite exercising all due care,
In these cases, any obligation on the part of voyageplan to pay damages or compensation for non-material damage, loss of enjoyment or self-remedy measures is excluded.
11.2.3 Personal injury
voyageplan is liable for personal injury resulting from the non-performance or improper performance of the contract within the scope of these general terms and conditions of travel, the applicable international agreements and conventions, the laws based on international conventions and national laws.
11.2.4 Other damage (damage to property, financial loss, etc.)
For other damage, i.e. damage that is not personal injury and results from the non-performance or improper performance of the contract, voyageplan’s liability is limited to a maximum of twice the travel price per traveller, unless the damage was caused intentionally or through gross negligence; this is subject to these general terms and conditions of travel, the applicable international conventions, the laws based on international conventions and national laws that provide for lower limits of liability or exclusions of liability.
11.2.5 Lost time, loss of holiday enjoyment, etc.
voyageplan is not liable for lost time, loss of holiday enjoyment, frustration, etc. during your holiday.
11.2.6 Valuables, cash, jewellery, credit cards, photo/video equipment, mobile phones, etc.
We expressly point out that you are responsible for the safekeeping of valuables, cash, jewellery, credit cards, photo and video cameras, mobile phones, etc. In hotels, valuables should be kept in the safe. Under no circumstances should these items be left in an unattended vehicle or otherwise unsupervised. We accept no liability for theft, loss, damage or misuse of valuables, cash, jewellery, credit cards, photo and video equipment, mobile phones, etc.
11.2.7 Timetables for cars, trains, flights, ships, etc.
Despite careful travel planning, we cannot guarantee that timetables and flight schedules will be adhered to. Delays may occur in particular due to heavy traffic, congestion, accidents, overloaded airports, diversions, delays in customs clearance, etc. We accept no liability in such cases. We recommend that you allow for possible delays when planning your trip.
11.3 Events during the trip
During the trip, local events or excursions outside the agreed travel programme may be booked. It cannot be ruled out that such events and excursions involve risks. You take part in such events and excursions at your own risk. These events and excursions are run by third-party companies (third-party services). voyageplan is not your contractual partner and accepts no liability whatsoever. They remain third-party services even if you book them through one of our local representatives or a tour guide of the tour operator takes part in them.
11.4 Non-contractual liability
Non-contractual liability is governed by the statutory provisions and the relevant international conventions. For other damage (i.e. damage that is not personal injury), liability is in all cases limited to twice the travel price per person or per traveller, unless international conventions, laws based on international conventions, national laws or these general terms and conditions of travel provide for lower limits of liability or an exclusion of liability.
11.5 Limitation period
All claims become time-barred one year after the contractual end of the trip. This is subject to shorter limitation periods under international conventions, laws based on international conventions or national laws, or to longer limitation periods that cannot be modified by contract.
When planning your onward journey after arriving in Switzerland, please allow for possible delays to your flight, train or taxi. Delays on arrival are always possible, even with good travel planning. If you arrive at Geneva or Zurich airport, for example, you should allow at least 120 minutes before your train departs. After long-haul flights, this time should be extended accordingly. Remember that passport and customs checks can take a long time.
The liability of travel, transport and aviation companies is limited. voyageplan therefore recommends that you take out additional insurance such as luggage insurance, cancellation insurance, travel accident and travel health insurance, additional return journey insurance, etc. If you have your own insurance (TCS ETI-Schutzbrief, Mobiliar, Intertour/Winterthur), please let us know.
14.1 Entry requirements
The trip description contains information on passport and entry formalities. This information applies to citizens of Switzerland and Liechtenstein. Nationals of other countries are asked to state their nationality when booking so that the booking agent can inform them of the applicable regulations.
Your booking agent assumes that there are no special circumstances such as dual citizenship, statelessness, etc.
14.2 Schengen Area states
If you, as a national of a Schengen state, travel from one Schengen state to another, your travel documents will not be checked systematically. Nevertheless, you must be able to identify yourself with the required travel documents at all times. This means you must carry the prescribed identity document with you at all times.
14.3 Visas and travel documents
You are responsible for obtaining or renewing travel documents, applying for a visa, etc. If a travel document cannot be obtained or is issued too late and you therefore have to cancel or change your trip, the cancellation provisions apply.
Visa applications must always be filled in completely. First names and surnames must be given exactly as they appear in the identity document used.
14.4 Registration with authorities
14.4.1 Depending on your destination, you may need to register with a foreign authority in good time before travelling (e.g. USA: Electronic System for Travel Authorization - ESTA, https://esta.cbp.dhs.gov/, accessed on 18 August 2011). Entry is only possible if you have received entry authorisation. Your booking agent will draw your attention to this procedure, but you are responsible for registering yourself.
If you or your fellow travellers are refused entry or do not receive entry authorisation, services not yet used cannot be refunded.
Such entry registrations may be subject to a fee. These costs are borne by you.
14.4.2 You may also have to fill in additional forms for entry into the destination country at the departure airport or during the flight. These are forwarded to the relevant authorities (for example USA: Advance Passenger Information System). Many airlines have published the relevant forms on their website so that they can be completed in advance. Your booking agent will be happy to provide information about this; you will also find it in your travel documents.
14.5 Compliance with entry requirements
Travellers are themselves responsible for complying with entry, health and currency regulations. Before departure, please check that you have all the necessary documents with you.
14.6 Refusal of entry
voyageplan points out that if you are refused entry, the costs of the return journey are borne by you. voyageplan also expressly draws your attention to the legal consequences of importing prohibited goods and other items.
14.7 Luggage regulations
Your booking agent will inform you of the general luggage regulations; you will also find this information in your travel documents. Some airlines charge additional fees for luggage that are not included in the travel price. Additional fees may also apply for excess luggage, surfboards, golf bags, etc. In some cases, such luggage can only be carried with prior approval. You are responsible for registering it.
On unaccompanied trips, you are responsible for reconfirming your return flight. You will find the necessary details in your travel documents. Failure to reconfirm may result in the loss of your right to carriage; any additional costs are borne by you.
